PARLAMENTARIOS EUROPEOS ENVÍAN UNA CARTA AL PRESIDENTE PASTRANA EN APOYO AL
PUEBLO UWA.

Respetado Sr. Presidente:
Estamos conmovidos y preocupados por las noticias que nos llegan desde Cubará
(Boyacá,
Colombia). Sabemos que policías antimotines llegaron el 7 de septiembre. De
acuerdo con lo
informado por el pueblo U'wa, los Policías dijeron que tienen orden, directa de
la oficina del
Presidente de Colombia, desalojar a todos los civiles presentes en el área que
circunda al pozo
exploratorio Gibraltar, hasta 500 metros a la redonda.
Según los U'wa, un cabo de la Policía antimotines dijo: "Allí no tiene que
estar ningún civil
dentro de 500 metros alrededor del pozo." Ni los indígenas ni los campesinos han
visto hasta el
momento una orden judicial o administrativa escrita, pero según lo que
comunicaron los policías
antimotines a los U'wa, el objetivo del desalojo es traer a la maquinaria de la
Occidental
Petroleum desde Saravena para la perforación.
Pensamos que este desalojo, de presentarse, sería una abierta violación a la
reciente sentencia
de tutela proferida por el honorable Tribunal Superior de Norte de Santander que
ordenó a la
Occidental Petroleum usar solamente el área previamente delimitada por un juez.
Además hemos conocido que el 11 de septiembre la junta directiva del Incora ha
constituido una
Zona de Reserva Petrolera al rededor del pozo Gibraltar 1 lo cual es una nueva y
grave maniobra
para desconocer, tanto el territorio tradicional del pueblo U'wa, como su
propiedad comunal
sobre terrenos, de los cuales tiene escrituras legítimas debidamente
registradas.
Considerando que:
El articulo 63 de la Constitución colombiana considera inalienables las tierras
comunales de
los grupos étnicos;
Las tierras donde se adelanta la exploración petrolera forman parte del
patrimonio inmemorial
del pueblo U'wa y de su territorio tradicional y
El pueblo U'wa no fue consultado sobre los trabajos que actualmente adelanta la
Occidental
Petroleum;
Nos dirigimos a usted para que detenga cualquier procedimiento de hecho contra
el pueblo U'wa y
para que no se repitan los lamentables hechos ocurridos el 24 y 26 de junio, el
11 de febrero y
el 25 enero del presente año, hechos que costaron la vida a tres niños indígenas
y heridas a
otros indígenas y campesinos.
Pensamos que el conflicto entre los U'wa y la Occidental Petroleum debe ser
resuelto en una
forma no violenta y especialmente mediante la consulta, en los términos del
Convenio 169 de la
Organización Internacional del Trabajo aprobado y ratificado por Colombia y
teniendo en cuenta
lo dispuesto en el parágrafo del artículo 330 y los artículos 63 y 93 de la
Constitución
Colombiana.
En ningún caso las personas y organizaciones que defendemos activamente los
derechos humanos
podríamos aceptar que se siga matando e hiriendo a los U'wa y a quienes se
solidarizan con
ellos.

Dear Mr. President:
We are profoundly concerned about recent news we have received from the
U'wa community
in Cubará (Boyacá, Colombia). We are aware that the anti-riot police arrived in the área on
September 7. According to the U'wa, the police stated that they have an order
direct from the
Colombian Presidency to evict all civilians present in a 500 meter radius
surrounding the
exploratory well site of Gibraltar.
According to the U'wa, a member of the anti-riot police said: "There
must be no
civilians inside a 500 meter radius of the well." Neither indigenous nor
campesino leaders
have yet received a written judicial or administrative eviction order. However,
according to
what the anti-riot police communicated to the U'wa, the purpose of the eviction
is to bring in
Occidental Petroleum's machinery from Saravena to the drill site.
We believe that this eviction would constitute an open violation of the
recent ruling
of the honorable Superior Court of Norte de Santander, which authorized
Occidental Petroleum's
use of only the land previously set aside for such activity in a judicial order
Additionally, we have learned that on September 11, the executive board of
Incora created a
Petroleum Reserve Zone around the the Gibaltar well site. This constitutes a
new attempt to disregard the rights of the U'wa people to their traditional territory and to
their communal
ownership of farms to which they have legitimate, written, and duly registered
titles.
Considering:
that Article 63 of the Colombian Constitution states that communal territory of
ethnic groups
is inalienable;
that the land slated for petroleum exploration forms part of the immemorial
patrimony of the
U'wa people and of their traditional territory; and
that the U'wa people were not consulted with regarding the work that is currently being carried
out by Occidental Petroleum;
We implore you to take action to protect the rights of the U'wa and to take
action to prevent a
turn of events like that which occurred on June 25th and 26th, on February 11th,
and on January
25th of this year, when actions of the public forces against the U'wa resulted in the drownings
of three indigenous children and caused multiple injuries to indigenous people
and campesinos.
We believe that the conflict between the U'wa and Occidental Petroleum
must be resolved
through nonviolent means, especially through consultation under the terms of
Convention 169 of
the International Labour Organization, which was signed and ratified by Colombia
and through
consideration of the terms of Article 330 and Articles 63 and 93 of the
Colombian Constitution.
Under no circumstances can we individuals and organizations actively defending
human rights
accept continued violence against the U'wa and against the people who are in
solidarity with
them.
