Información enviada al Director de Tlahui. Filipinas a 7 de Enero, 1999. Asociación de Familiares de Desaparecidos y Víctimas de Violaciones a los Derechos Humanos en México, AFADEM(FEDEFAM/México). Desapariciones Forzadas. Hacemos de su conocimiento la siguiente denuncia sobre desapariciones forzada, recibida en ingles de KARAPATAN, el 7 de enero de 1999, la cual hemos traducido para su comodidad. Les anexamos texto de la original al final de la traducción.

Caso: Desapariciones Forzadas

Víctimas: Jayson NIEVA, 18 años de edad y Danilo CAISIP, 27 años de edad.

Fecha de incidente: 8 de diciembre de 1998.

Lugar del incidente: Sitio Kaybamban, Brgy. Karylaw, Nasugbu, Batangas.

Autores: Armed barangay tanods, dirigidos por el Capitán de Brgy, Gerpacio, quien posteriormente entrego a las Víctimas al 401st PNP Mobile Force Company.

Motive/Causa: Contra-insurgencia, sospechosos de ser miembros del Nuevo Ejercito del Pueblo.

¡AYUDEN A ENCONTRAR A DANILO Y JAYSON!

Antecedentes:

8 de diciembre de 1998. Ese día, de acuerdo a Roberta Ibanyez Caisip, madre de Danilo, su hijo y su amigo Jayson pidieron permiso para viajar a Brgy. Karylaw, Nasugbu Batangas. Lo siguiente que supo, sin embargo, de acuerdo a testigos que urgentemente le informarban de las detenciones, tanto de Danilo como de Jayson por las autoridades mencionadas.

9 de diciembre de 1998. Roberta acompañada por otros familiares, se acerco a KARAPATAN-Batangas en busca de ayuda respecto al caso de las desapariciones tanto de Danilo como de Jayson.

CIRCUNSTANCIAS DEL EVENTO

12 de diciembre de 1998. En una Investigación de los hechos, conducida por los familiares de las Víctimas, algunos grupos pro causa en el área y gente de la iglesia, se obtuvieron los siguientes resultados:

-Cuando el equipo fue a la residencia del Capitán Jorge Gerpacio en Brgy., el y sus vecinos no se encontraban a la mano. -Asimismo el equipo encontro el palacio municipal de Barangay de Brgy.

Karilaw, questionablémente abandonado. -Raro también, fue la ausencia de todos los tanods de Barangay y consejeros de barrio, a excepción del consejero Mújica.

En la entrevista, el Consejero Mújica admitio tener conocimiento del arresto y subsecuente interrogación tanto de Danilo como de Jayson, la cual fue aparentemente realizada dentro del palacio municipal de Barangay. Sin embargo no tenia idea alguna a donde se habían llevado a los dos posteriormente.

De acuerdo a reportes de algunos residentes, quienes declinaron identificarse, los autores amarraron las manos de las dos Víctimas, luego los arrastraron al palacio municipal de Barangay donde los golpearon brutalmente.

Los autores fueron identificados como el Capitán Jorge Gerpacio, Gregorio Dimapilis, dirigente del equipo de tanods de sitio Kaybamban, Eric Gerpacio, un sobrino de Jorge, Serafín Alegre, Domingo de Padua, Rudy Vidal e individuos aun no identificados.

10 de diciembre de 1998. El Capitán de Bundukan, Brgy, Primitivo HERNÁNDEZ, junto con familiares de las Víctimas y representantes de KARAPATAN-Batangas fueron a indagar e investigar en Barangay Kayrilaw. Fue aquí donde el Capitán Jorge Gerpacio de Brgy., le dijo a la misión que de hecho, los tanods de Barangay le hanbian informado de los arrestos de dos supuestos miembros del Nuevo Ejercito del Pueblo, quienes subsecuentemente fueron llevados al palacio municipal de Barangay, y que pronto después de su Investigación, los dos habían sido puestos en libertad. Igualmente, ordeno al grupo que ya no estuviera molestando Brgy, Kayrilaw, anyadiendo que Danilo y Jayson habían ido a las tierras altas ("Ang dalawang nahuli ay papunta ngmataas na pulo")

El grupo también hablo con un tal Pastor Gerpacio, un tanod de Barangay, que les informo que su sobrino había admitido el arresto de los dos hombres, uno alto y otro bajo de estatura, por posesión ilegal de armas de fuego y explosivos. También de acuerdo a Gregorio Dimapilis, dirigente de equipo de los tanods los dos hombres fueron entregados al 401st PNP Mobile Force de Palico. Al preguntarsele que porque los dos no habían sido llevados directamente a la municipalidad, Gregorio dijo que el "Capitán" quería que fueran llevados directamente a Palico.

11 de diciembre de 1998. Retractándose de lo que había dicho anteriormente, el Capitán Jorge Gerpacio candidamente le dijo al equipo que había entregado a las Víctimas al 401st PNP Mobile Force Company, con base en Palico, Nasugbu. Los familiares de las Víctimas visitaron el cuartel de las PNP, pero un tal SPO4 Mercado, negó cualquier conocimiento del arresto. Asimismo, presente durante esta indagación estuvo un Mayor Israel Ephraim, el Jefe Ejecutivo de la Mobile Force, quien con la intención de hostigar, le dijo al Capitán HERNÁNDEZ que muchos de los residentes de Barangay de FERNÁNDEZ, ya eran del Nuevo Ejercito del Pueblo, que quizas debian programar una visita al área. ("Marami na pala sa inyong NPA, i-iskeduel nga namin ang pagpunta roon").

Al momento, no se han encontrado indicios de Danilo Caisip ni de Jayson Nieva.

URGENT ACTION REQUEST
CASE : INVOLUNTARY DISAPPEARANCES

MOTIVE/CAUSE : Counter-insurgency, suspected of being members of the New People's Army

HELP FIND DANILO and JAYSON!

BACKGROUND

8 December 1998. That day, according to Roberta Ibañez Caisip, mother of Danilo, her son and his friend Jayson asked permission to travel to Brgy. Kayrilaw, Nasugbu, Batangas. The next thing she knew, however, witnesses were urgently informing her of the apparent arrests of both Danilo and Jayson by the said perpetrators. 9 December 1998. Roberta, together with relatives, approached KARAPATAN-Batangas, to seek assistance regarding the disappearance of both Danilo and his friend Jayson.

CIRCUMSTANCES OF THE EVENT

12 December 1998. In a Fact Finding Mission conducted by the relatives of the victims, some cause oriented groups in the area, individuals and church people, the following were the acquired results:

-when the team went to the residence of Brgy. Captain Jorge Gerpacio, he and his neighbors were not at hand.

-the team likewise discovered the barangay hall of brgy. Kayrilaw, questionably abandoned. -odd too, was the absence of all the barangay tanods and councilors of the barrio, except for one Councilor Mójica.

When interviewed, Councilor Mójica admitted knowledge of the arrest and subsequent interrogation of both Danilo and Jayson, which was apparently performed inside the barangay hall. However, he had no idea where the two were brought afterwards.

According to reports by some residents who declined to be identified, the perpetrators manacled the hands of both victims then dragged them to the barangay hall and brutally mauled them.

The perpetrators were identified as Brgy. Captain Jorge Gerpacio, Gregorio Dimapilis, team leader of the barangay tanods from Sitio Kaybamban, Eric Gerpacio, a nephew of Jorge, Serafin Alegre, Domingo de Padua, Rudy Vidal and additional individuals still unidentified.

10 December 1998. The Brgy. Captain of Bundukan, Primitivo HERNÁNDEZ, together with the relatives of the victims and the representatives of KARAPATAN-Batangas all went to inquire and investigate in barangay Kayrilaw. It was here when Brgy. Captain Jorge Gerpacio told the mission team that indeed, the barangay tanods informed him of the arrest of two alleged NPA's who were subsequently brought to the barangay hall, and that soon after their investigation both were set free. He likewise ordered the group not to bother any further brgy. Kayrilaw, adding that Danilo and Jayson had gone to the highlands. ("Ang dalawang nahuli ay papunta ng mataas na pulo").

The group also spoke to one Pastor Gerpacio, a barangay tanod, who informed them that his nephew admitted the arrest of two men, a tall one and a short one, for illegal possession of firearms and explosives. Also according to Gregorio Dimapilis, team leader of the tanods, the two men were fetched by the 401st PNP Mobile Force of Palico. Asked why the two men were not brought directly to the municipality, Gregorio said that the "Kapitan" wanted them brought straight to Palico.

11 December 1998. Retracting what he had said earlier, Brgy. Captain Jorge Gerpacio guilefully told the team that he had turned over the victims to the 401st PNP Mobile Force Company based in Palico, Nasugbu. The victims' relatives visited the PNP headquarters but a certain SPO4 Mercado denied any knowledge of the arrest. Likewise present during the inquiry was one Major Israel Ephraim, the CO of the Mobile Force. Harassingly, he told Brgy. Captain HERNÁNDEZ that many of the residents of FERNÁNDEZ's barangay are already NPA's, that perhaps they should schedule a visit in the área. ("Marami na pala sa inyong NPA, i-iskedyul nga namin ang pagpunta roon").

To this day, no traces of Danilo Caisip and Jayson Nieva have been found.
