Excelencia,

Con sobrecogimiento y estupefacción recibo las recientes informaciones que llegan de Kosovo acerca del desbordante número de refugiados que huyen hacia los países vecinos. Muchos de estos refugiados relatan vivencias que, de confirmarse, parecieran pertenecer a un tiempo y lugar supuestamente ya pasados: declaraciones de violencia indiscriminada, destrucción y robo de propiedades, desplazamientos en masa, y, asesinatos, tortura y violencia sexual perpetrados sistemáticamente.

Deseo dejar bien claro el papel del Tribunal Penal Internacional para la Antigua Yugoslavia en esta crisis: el Tribunal tiene jurisdicción sobre violaciones de las leyes y usos de la guerra, graves infracciones a las Convenciones de Ginebra, crímenes contra la humanidad y genocidio cometidos en el territorio de la Antigua Yugoslavia desde el 1 de enero de 1991 hasta el día de hoy.

No existe norma alguna que limite estos crímenes. Las personas imputadas por la acción de este Tribunal lo continúan estando hasta que sean llevadas a juicio. Si bien la situación sobre el terreno puede variar, no sucede así cuando hablamos de leyes. Los crímenes serán investigados y, en su caso, sus autores serán acusados y juzgados.

Como he venido repitiendo a lo largo de los 18 últimos meses, si bien el Tribunal tiene mandato para investigar, procesar y celebrar juicios, no puede cumplir con el mismo sin la colaboración activa de los Estados de la comunidad internacional. Todos aquellos Estados y organizaciones que estén en posesión de información relativa a la comisión de crímenes que recaen sobre la jurisdicción del Tribunal, deben poner esta información en manos de la Fiscalía en el menor plazo posible. Varios países miembros de la OTAN han expresado su voluntad de colaborar con el Tribunal poniendo a disposición del mismo toda la evidencia que obre en su poder. Confío en que todos los miembros del Consejo del Atlántico Norte prestarán asistencia al Tribunal suministrándole cualesquiera pruebas de ilícitos penales de que dispongan.

El Tribunal trabaja intensamente y en circunstancias difíciles, careciendo de los recursos propios de los tribunales nacionales. Aunque se trate de un proceso relativamente a largo plazo, con muchos obstáculos, el Tribunal cumplirá con su mandato. La cooperación de su Gobierno con el mismo contribuirá a favorecer nuestra labor.

Excellency,

I am stunned and horrified by the recent reports from Kosovo of the overwhelming number of refugees fleeing to neighbouring States. Many of these refugees recount experiences that, if true, belong in a time and place that we are supposed to have left behind: allegations of indiscriminate violence, destruction and theft of property, mass round-ups, and systematic torture, rape and murder.

I wish to be very clear regarding the role in this crisis of the International Criminal Tribunal for the former Yugoslavia: the Tribunal has jurisdiction over violations of the laws or customs of war, grave breaches of the Geneva Conventions, crimes against humanity and genocide committed in the territory of the former Yugoslavia from 1 January 1991 to the present.

There are no statute of limitations for these crimes. Persons indicted by the Tribunal thus remain indicted until they are brought to trial. While the situation on the ground may change, the law does not. Crimes will be investigated and where appropriate, persons will be charged and tried.

As I have repeatedly emphasized during the past 18 months, while the Tribunal has the mandate to investigate, prosecute and conduct trials, it cannot do so without the active assistance of the States of the international community. All States and organisations in possession of information pertaining to the alleged commission of crimes within the jurisdiction of the Tribunal should make such information available without delay to the Prosecutor. Several NATO Member States have expressed a willingness to assist the Tribunal with providing such evidence. I am confident that all Members of the North Atlantic Council will assist the Tribunal in providing any evidence of criminal wrongdoing in their possession.

The Tribunal works tirelessly under difficult circumstances, lacking the resources which national courts rely on. Although this is a relatively long-term process with many obstacles, the Tribunal will discharge its mandate. The co-operation of your Government will assist in this important endeavour.
